Your access to and use of the Site is subject to the following terms and conditions and all applicable laws. We may change these Terms of Use at any time without notice. By accessing and browsing our Site, you accept, without limitation or qualification, these terms and conditions. If you do not agree to them, please DO NOT USE THIS SITE. Your continued use of our Site evidences your agreement to be bound by each of the then posted Terms of Use and Be Bold Privacy Policy and constitutes a legally binding contract between you and Echoing Green. You agree that Echoing Green may provide to you electronically, required notices, agreements, and other information concerning the Site. Echoing Green will post the notices on the homepage of the Site or on the relevant web page of the applicable service. If you want to withdraw your consent to receive notices electronically, you must discontinue your use of the Site. Echoing Green respects the privacy concerns of our website users and future viewers. Registration

Certain portions of our Site may require registration. You agree to: (a) provide true, accurate, current, and complete information about yourself as prompted by the Site’s registration form (such information being the “Registration Data”) and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. Communications With Others On The Site
All user profiles (Bold Faces), resumes, and content in or on the chat boxes, message boards and other user generated content and/or communication tools (hereinafter referred to as "Planet Bold") are created by our users and not by Echoing Green. If you post nasty, insulting, sexually explicit, racially disparaging, religiously disparaging or other inappropriate content we have the right to delete it from the Site without notice and to freeze or close your account. This rule also applies to inappropriate user names. Do not create names that are nasty, insulting, sexually explicit, racist, disrespectful of religions or otherwise inappropriate. We can see your messages, so keep it clean and friendly! Do not abuse the chat functions by "spamming" (posting the same message many times) or using them to make "party boards" - this can result in warnings or a frozen account, too! Finally, if you ask for another user's password or personally identifiable information, for any reason, your account can be frozen or terminated. When posting resumes or other materials on the Site, we recommend that you not include any sensitive personally identifiable information, including, but not limited to, your social security number, email address, address or phone number. Instead, we suggest you limit contact information to your user name that will enable other users to contact you on the Site. Including such information may make you vulnerable to identity theft and collection of such information by commercial spammers and marketers. Additionally, if you choose to participate in Be Bold's Planet Bold or use any of the functionalities offered by the Be Bold website to enhance communication between users (including, but not limited to Connections, Personal Messaging and My Resume), you agree that Echoing Green will not be responsible or liable for any loss or damage arising from or in connection with communications from third parties.

Editing/Blocking
You understand that Echoing Green may supervise chat rooms and filter content sometimes, but that we don't have a duty to do this. You understand that bad people can use chat functions and that chat rooms can be dangerous places if you do not use caution and good sense. You agree that Echoing Green, in its sole discretion, shall have the right, but not the obligation, to edit, refuse to post or remove any material submitted to or posted on the Site, for any reason whatsoever, including, without limitation, if Echoing Green considers that the material constitutes or promotes gambling or any illegal activity, or if Echoing Green considers the material to be pornographic, sexually explicit, lewd, lascivious, filthy, violent, harassing or otherwise objectionable. Echoing Green’s Intellectual Property Rights and Limited License

Polls and Surveys

Contests and Sweepstakes, Promotions and Posting

Echoing Green may occasionally present a special contest, sweepstakes or promotion that is sponsored by Echoing Green or another organization. Tell a Friend

If a user elects to use our “Tell a friend” function, we ask them for the friend’s email address. We will automatically send the friend a one-time email inviting them to visit the website. We store this information temporarily for the sole purpose of sending this one time email.

A Special Note about Children, Children’s Privacy and Our Compliance with the Children’s Online Privacy Protection Act

Those who choose to access this Site from other locations do so on their own initiative and risk and are responsible for compliance with local laws regarding online conduct and acceptable content, if and to the extent local laws are applicable. Governing Law

The Terms of Use shall be governed by and construed in accordance with the internal laws of the United States and the State of New York governing contracts entered into and to be fully performed in the state of New York (i.e., without regard to conflict of laws provisions) regardless of your location. You acknowledge that the rights granted and obligations made hereunder to Echoing Green are of a unique and irreplaceable nature, the loss of which shall irreparably harm Echoing Green and which cannot be replaced by monetary damages alone so that Echoing Green shall be entitled to injunctive or other equitable relief (without the obligations of posting any bond or surety) in the event of any breach or anticipatory breach by you. You irrevocably waive all rights to seek injunctive or other equitable relief and agree to limit your claims to claims for money damages (if any). Except with respect to the interpretation, protection or enforcement of Echoing Green’s claimed intellectual property rights (which will only be subject to arbitration if the parties mutually agree), you agree that any suit, action or proceeding arising out of or relating to these Terms of Use or any of the transactions contemplated herein or any contests or services thereon (including, without limitation, statutory, equitable or tort claims) shall be resolved solely by binding arbitration before a sole arbitrator under the rules and regulations of the American Arbitration Association (“AAA”); The arbitration shall be held in New York, NY. The arbitrator shall apply the substantive laws of the New York, shall issue a written decision, and shall have the power to award any legal remedies consistent with this Agreement except for punitive, exemplary or special damages. The parties will split the arbitrator’s fee. You agree that the provisions in this paragraph will survive any termination of your account(s). You irrevocably agree that any and all disputes, claims and causes of action you may have in connection with or related to Echoing Green or their site will be resolved individually, without resort to any form of class action.

Severability

If any provision of these Terms of Use or the Privacy Policy are found to be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from the remainder, which will remain in force; the parties agree that the court should endeavor to give the fullest possible effect to the parties’ intentions as reflected in the provision and shall not affect the validity and enforceability of any remaining provisions.

Waiver

Any delay or failure on the part of Echoing Green to exercise or enforce any rights under these Terms of Use to which it may be entitled shall not, in any event, be construed as a waiver of the right and privilege to do so at any subsequent time. You irrevocably agree that you waive any and all rights to injunctive or other equitable relief.

Statute of Limitations

You agree that regardless of any statute or law to the contrary, any claim or cause of action, arising out of or related to, use of the Site or these Terms of Use must be filed in a court of applicable jurisdiction within one (1) year after such claim or cause of action arose or be forever barred.

Entire Agreement; Modification and Termination

Echoing Green reserves the exclusive right to modify, withdraw, suspend or discontinue, temporarily or permanently, at any time and from time to time any materials, information or content available on the Site and any functionality or features in or on the Site, including the cessation of all activities associated with the Site, with or without notice. You agree that Echoing Green shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Site.
